There are deficiencies in planning law and regulation when it comes to trees as with so many other things. The only way to "save" a tree in a Conservation Area is to award it a TPO, or for the Tree Officer to talk the Applicant out of the felling proposal. gaining a TPO is a high hurdle - the tree has to earn it in its own right - although being under threat of being felled does get points towards its score. It needs to be visible to many - and in a back garden that is nigh on impossible. It needs to have a good life ahead of it and be healthy. With Ash Die Back - if this one has it - that too is unlikely. An applicant does not have to give a reason for felling the tree which I have always found strange. Hopefully that mood will change.
