I object to this tree felling in principle. We desperately need every tree we have, and we need more. We must stop felling healthy mature trees. Yet this tree is in a back garden and the LPA's AO has few weapons in his/her armoury. The legislation here is very poor indeed. It attributes no worth to the value of a tree in protecting us - not least in sequestering carbon while it changes carbon dioxide into oxygen. The only value of a tree when it comes to saving it from being felled unnecessarily by awarding it a TPO in a Conservation Area is "How many people can see it?" Frankly I cannot think of a weaker value to attribute to a tree when it comes to arguments about whether it should be felled or not..
So no - this tree should not be felled - but it probably will not be awarded a TPO. I always hedge my bets here because it is up to the professional expertise of the AO.
The other poor parts of the same legislation are that - as here - no reason for the felling has to be given (some applicants do do this); and there is no obligation to replace the tree (The UoB always replaces trees it has to fell in a Conservation Area).
